Turkey makes charity membership legal again

As of June 28 Turkish individuals may once again become members of the charities they support

The Turkish Constitutional Court has annulled the Civil Code’s article 101 banning individuals from becoming members of charitable foundations. The court decision, taken on April 17, has now been published in the Official Gazette.  

The court appealed to Constitution article 33 that refers to associations, deeming that as it allows anyone to become a member of an association without the need for prior permission, the same should apply to charities.  The annulment was voted for unanimously.

The annulment of this expression in the Civil Code was made possible by the application of the 13th Ankara Court of First Instance and the 1st Gaziantep Court of First Instance.
